These Terms of Service govern your use of the website located at https://perfectwavees.com and any related services provided by PerfectWavees.

By accessing PerfectWavees, you agree to abide by these Terms and to comply with all applicable laws and regulations. If you do not agree, you are prohibited from using or accessing this website or using related services provided by PerfectWavees.

PerfectWavees may review and amend these Terms at any time. Upon doing so, we will update this page. Changes take effect from the publication date shown above unless we say otherwise.

Our acceptable use policy is incorporated into these Terms by reference.

Forecast data source (Open-Meteo)

Marine and weather forecast inputs displayed on PerfectWavees are sourced from Open-Meteo and are subject to Open‑Meteo Terms & Privacy, including (where stated there) data licence terms such as CC‑BY‑4.0.

Forecast data is retrieved by PerfectWavees’ automated backend systems on a recurring schedule, not directly from ordinary visitors’ browsers when they browse the website in a typical reading flow.

PerfectWavees is presented without subscriptions or paywalls, and without third‑party display advertising, consistent with our FAQ and with Open‑Meteo examples of permissible non‑commercial use where applicable.

You must not use PerfectWavees in a way intended to circumvent Open‑Meteo’s licensing or quotas—such as abusive automated scraping aimed at circumventing attribution, quotas, subscription requirements where they apply.

Open‑Meteo’s disclaimers regarding accuracy, availability, uptime, warranties, and liability apply to upstream data. You must read Open‑Meteo’s terms for authoritative wording.

Surfing and other ocean recreation carry inherent risk of serious injury or death. Forecasts—even when accurate—never replace your own judgement about whether conditions are suitable for your skill, fitness, equipment, local hazards, tides, currents, closures, etiquette, lifesaving directives, nautical rules, harbour authority announcements where legally applicable, and signage.

Limitations of use

By using this website, you warrant that you will not:

1. modify, reverse engineer beyond what mandatory law permits, or misuse software or compilations hosted on PerfectWavees in order to circumvent technical limits intended to preserve service integrity attribution requirements or quotas;
2. remove required notices including copyright notices trademark notices—or remove legally required attribution to upstream forecast licensors where attribution must remain intact;
3. transfer or “mirror” PerfectWavees’ materials externally for unauthorised competing commercial redistribution;
4. use the website in a manner that knowingly or recklessly abuses or disrupts PerfectWavees’ networks integrations hosting vendors CDN providers workers object storage queues cron automation—or upstream forecast providers—including Open‑Meteo;
5. use the website to transmit or publish unlawful harassing indecent obscene fraudulent infringing discriminatory or threatening material—or material that violates someone else’s rights;
6. use the website in violation of laws regulations official marine advisories unauthorised access unauthorised messaging spam phishing malware credential attacks harvesting personal information without lawful basis consent where required;
7. use the website in conjunction with unauthorised advertising spam bulk unsolicited messaging deceptive promotions;
8. harvest, collect, or gather personal information about visitors without a lawful basis and, where consent is required, without consent;
9. use the website in any way that may infringe the privacy, intellectual property rights, contractual duties, or other rights of third parties, or breach our acceptable use policy;

Intellectual property

The materials contained in this website (including branding, user interface composition, illustrative copy where present, compiled spot descriptions, explanatory surf summaries, news or quiz pages where offered, integrations, tooling, compilation of metadata, heuristic ratings summaries, slogans appearing on pages, curated lists, typography and layout excluding upstream forecast licensors’ rights expressly reserved upstream) are owned by or licensed to PerfectWavees and are protected under applicable intellectual property laws.

Forecast fields themselves remain governed by licences described by Open‑Meteo and other licensors; appropriate attribution appears on PerfectWavees as required.

Beyond what mandatory law expressly allows, PerfectWavees grants you permission only to browse the website transiently—for example through ordinary browser caches and temporary copies incidentally created for lawful personal viewing—not to systematically reproduce or scrape the corpus for unauthorised competing redistribution.

Where permission is granted, it is a licence, not a transfer of title. The licence ends automatically if you violate these Terms or if licences upstream require us to discontinue your permission. Permission may also be ended by PerfectWavees where permitted.

Disclaimer of warranties; limitation of liability

Our website and the materials on our website are provided on an “as is” basis. To the extent permitted by law, PerfectWavees makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement of intellectual property, or other violation of rights.

To the extent permitted by law, in no event shall PerfectWavees or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if PerfectWavees or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

For the avoidance of doubt, “consequential loss” includes consequential or indirect losses, and may include reputational harms to the extent characterised as consequential under applicable law.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

The materials appearing on our website are not comprehensive and are for general information purposes only. PerfectWavees does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on this website, or otherwise relating to such materials or on any resources linked to this website.
